Supreme Court Rules Gay Sex Illegal in India

According to a latest report, India's Supreme Court has overturned the ruling earlier given by a lower court on Wednesday. The ruling of the lower court decriminalized or legalized gay sex in India, but according to the new ruling by the Supreme Court the same has been illegalized on the 11th of December 2013.

It has been revealed by sources, that the Delhi High Court had ruled in 2009 that a 19th-century provision in the nation's penal code that banned gay sex should not be applied to consensual relationships.

But on the contrary, the Supreme Court rejected the same decision made by the Delhi High Court and said that the old law is still valid in India and only the Parliament has the power to change or erase the law, not the courts.

The rights groups, on the other hand, are not satisfied with the present decision of the Supreme Court and say that the Section 377, for its place in a 150-year-old Indian penal code, has been used in order to harass the homosexuals for decades.

Two supreme-court judges who presided over the case said, "We hold that Section 377 IPC does not suffer from the vice of unconstitutionality and the declaration made by the Division Bench of the High court is legally unsustainable".
