Apple may lose patent war against Samsung in Germany

South Korean electronic giant Samsung may soon be allowed to sell its redesigned Galaxy Tab tablet in the, thanks to a German court’s preliminary ruling that the redesigned tablet is not a copycat version of Apple’s iPad.

Previously, the German court had ruled in favor of Apple, forcing the South Korean manufacturer to modify its Galaxy Tab 10.1 and name it Galaxy Tab 10.1N.

But, the Cupertino, Calif.-based gadget maker challenged even the redesigned version of the Galaxy Tab and requested the court for an injunction on the distribution of the devise in Germany.

However, this time the court ruled in favor of Samsung. Pronouncing the judgment on Thursday, Judge Johanna Brueckner-Hofmann said, “According to the court’s assessment, the defendant has moved away sufficiently from the legally protected design.”

Apple and Samsung are fighting several legal battles against each other over their intellectual property used in smartphones and tablet computers.

Patent infringement cases started multiplying last year as smartphone and tablet computer manufacturers intensified their efforts to dominate the lucrative global gadgets market.
